3.  THE DATA WE COLLECT ABOUT YOU  

Personal data, or personal information, means any information about an individual from which that person can be identified either by itself or in conjunction with other data likely to be in our possession. It does not include data where the identity has been removed (anonymous data).

  • Identity Data includes company name, first name, maiden name, last name, marital status, title, date of birth, gender, copies of identification documents and address verification documents.

  • Technical Data includes internet protocol (IP) address, your login data, cookies, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform and other technology on the devices you use to access this website. It may also include receipts and clicks on e-mails we send from our automated e-mail system.

  • Special Categories of Personal Data in certain circumstances, we may also have information on your ethnic or racial origin, religious or philosophical beliefs and, where relevant, information about individuals’ criminal records or offences or even details as to sex life or preferences (for instance obtained through a disclosure process during a provision of legal services). Biometric data such as fingerprints may also be required for access control to our premises.
  • Aggregated Data may also be collected, such as statistical or demographic data for any purpose. Aggregated Data may be derived from your personal data but is not legally considered as personal data  as this data does not directly or indirectly reveal your identity. For example, we may aggregate your usage data to calculate the percentage of users accessing a specific website feature. However, if we combine or connect Aggregated Data with your personal data so that it can directly or indirectly identify you, we treat the combined data as personal data, which will be used in accordance with this Privacy Notice.

IF YOU FAIL TO PROVIDE PERSONAL DATA
Where we need to collect personal data by law, or under the terms of a contract we have with you, and you fail to provide that data when requested, we may not be able to perform the contract we have, or are trying to enter into, with you. In this case, we may have to cancel our services to you, but we will notify you if this is the case at the time.

5.  HOW WE USE YOUR PERSONAL DATA  

We will only use your personal data when the law allows us to. Most commonly, we will use your personal data in the following circumstances:

  • Where we need to perform the contract we are about to enter into, or have entered into, with you. ‘Performance of Contract’ means processing your data where it is necessary for the performance of a contract to which you are a party or to take steps at your request before entering into such a contract.
  • Where it is necessary for our legitimate interests (or those of a third party) and your interests, where there are no fundamental rights which override these interests. ‘Legitimate Interest’ means the interest of our business in conducting and managing our business to enable us to give you the best service/product and the best and most secure experience. Where you opt out of receiving these marketing messages, you will no longer receive marketing communication from us.  Opting out of third party marketing messages, with whom you consented to opt in through us, should be requested from the relevant third party.

You should note that opting out of marketing communication will only apply to marketing purposes.  It does not apply to personal data provided to us as a result of a service or business transactions.

If you disable or refuse cookies, please note that some parts of the website may become inaccessible or not function properly. Information regarding our cookie policy may be found on each company’s website within the EMCO Group.

We use tracking technology to collect information on your activities on our webpage. This is done for instance when you open e-mails, view our webpage, through links to webpages when you RSVP to an event and when you unsubscribe. This information is used in order to assess that what is being sent to you is of interest. For events, RSVP’s are required to make appropriate event arrangements.

CHANGE OF PURPOSE

We will only use your personal data for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If you wish to get an explanation as to how the processing for the new purpose is compatible with the original purpose, please contact us. 

If we need to use your personal data for an unrelated purpose, we will notify you and we will explain the legal basis which allows us to do so.

Please note that we may process your personal data without your knowledge or consent, in compliance with the above rules, where this is required or permitted by law.

6.  DISCLOSURE OF YOUR PERSONAL DATA  

We may have to share your personal data with the parties set out below, for the purposes set out in the table above.

  • Internal Third Parties which are the companies comprising the EMCO Group acting as joint controllers and processors who are based in Cyprus, England, Lebanon and Egypt.
  • External Third Parties:

 1. Service providers acting as processors who provide IT and system administration services.

 2. Professional advisers acting as processors including lawyers,         bankers, auditors and insurers based in Cyprus, England, Lebanon and Egypt which provide consultancy, banking, legal, insurance and accounting services.

3. Revenue & Customs, regulators and other authorities acting as processors based in Cyprus, England, Lebanon and Egypt which require reporting of processing activities in certain circumstances.

  • Third parties to whom we may choose to sell, transfer, or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your personal data in the same way as set out in this Privacy Notice.

We require all third parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third party service providers to use your personal data for their own purposes, and we only permit them to process your personal data for specified purposes and in accordance with our instructions.

 

7.  INTERNATIONAL TRANSFERS  

We share your personal data within the EMCO Group. This will involve transferring your data outside the European Economic Area (EEA).

We ensure your personal data is protected by requiring all our group companies to follow the same rules when processing your personal data. These rules are called “binding corporate rules”. For further details, see European Commission: Binding corporate rules.

Many of our External Third Parties are based outside the European Economic Area (EEA) so their processing of your personal data will involve a transfer of data outside the EEA.

If the transfer of your data to a service provider is located in a country where adequate personal data protection is not in place, we will only do so if:

  • The transfer is necessary for the establishment, exercise and/or defence of legal claims;
  • We have your explicit consent;
  • The transfer is necessary for the performance of a contract in your interest and we are a party to the contract; or
  • The transfer is necessary in order to perform a contract between us and you, or to carry out pre-contractual measures at your request.
  • Where we use providers based in the US, we may transfer data to them if they are part of the EU-US Privacy Shield which requires them to provide similar protection to personal data shared between Europe and the US.

8.  DATA SECURITY  

We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.

We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

As the transmission of data through the internet is not completely secure and, although we do our best to protect it, the data transmitted to our website is at your own risk. After receiving your data, we will endeavour through procedures and security features to secure the data.

9.  DATA RETENTION  

HOW LONG WILL YOU USE MY PERSONAL DATA FOR?

We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting or reporting requirements.

To determine the appropriate retention period for personal data, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements.

 

10.  YOUR LEGAL RIGHTS  

Under certain circumstances, you have rights under data protection laws in relation to your personal data.

You have the right to:

  • Request that your data is not processed for marketing purposes to the extent that it is related to direct marketing.
  • Request access to your personal data (commonly known as a “data subject access request”). This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.
  • Request correction of the personal data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.
  • Request erasure of your personal data. This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing your personal data (see below), where we may have processed your information unlawfully or where we are required to erase your personal data to comply with local law. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain services to you.
